DAHN Terms of Use

1. Acceptance of Terms
By accessing or using DAHN (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and a licensed healthcare professional, agency, or authorized staff member to use the Service for clinical documentation.
3. Account Responsibilities
- Keep your login credentials confidential.
- You are responsible for all activity under your account.
- Notify us immediately of any unauthorized access.
4. Acceptable Use
- You agree not to use the Service for unlawful purposes or in violation of HIPAA or other regulations.
- You agree not to attempt to reverse engineer, scrape, or disrupt the Service.
- You agree not to upload content that infringes on third-party rights.
5. Subscriptions & Billing
Paid plans are billed in advance on a recurring basis (monthly or annually). Your subscription automatically renews until canceled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
Pricing Changes: We reserve the right to modify subscription pricing at any time. In the event of a price increase, you will receive advance notice via email or through the Service at least 30 days prior to the change taking effect. By continuing to use the Service after a price change, you agree to the updated pricing. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect. No refunds will be issued for any price changes.
6. No Refunds Policy
All payments made to DAHN are final and non-refundable. We do not provide refunds, credits, or prorated reimbursements for any subscription fees, including but not limited to unused portions of a billing period, partial months or years, accidental purchases, account cancellations, or dissatisfaction with the Service. By subscribing, you expressly acknowledge and agree to this no-refund policy. Chargebacks or payment disputes in violation of this policy may result in immediate suspension of access. If you cancel your subscription, you will retain access to paid features until the end of your current billing period, but no refund will be issued.
7. HIPAA Compliance
DAHN is designed to support HIPAA compliance for healthcare organizations. By using the Service, you acknowledge that you are responsible for your own HIPAA compliance, including ensuring that all users under your account understand and follow applicable policies.
Business Associate Agreements:
If you are a Covered Entity or Business Associate under HIPAA, we will execute a Business Associate Agreement (BAA) upon request. The BAA defines the permitted and required uses and disclosures of Protected Health Information (PHI) by DAHN. Contact info@dahn.ai to request a BAA.
Your Responsibilities:
- Maintain appropriate authorization and consent documentation for PHI you enter.
- Ensure all users with access to PHI are properly trained on HIPAA requirements.
- Report any suspected unauthorized access or breach to us immediately.
- Use strong, unique passwords and enable any available multi-factor authentication.
- Do not share account credentials or allow unauthorized individuals to access the Service.
Our Commitments:
- Administrative, physical, and technical safeguards to protect PHI.
- Encryption of data in transit and at rest.
- Access controls and audit logging.
- Breach notification within the timeframes required by HIPAA.
- Subcontractor oversight and BAA enforcement for any downstream service providers.
DAHN does not monitor, verify, or validate the accuracy of any clinical content entered into the Service.
8. Clinical Disclaimer
The Service is a documentation tool and does not provide medical advice, diagnosis, or treatment. You are solely responsible for the accuracy, completeness, and clinical appropriateness of all content you create.
9. Intellectual Property
The Service, including all software, branding, and content provided by us, is owned by DAHN and protected by intellectual property laws. You retain ownership of the content you create.
10. Termination
We may suspend or terminate your access to the Service for violations of these Terms or applicable laws. Where reasonable, we will provide notice.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, DAHN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, any loss of data, unauthorized access, or errors in clinical documentation.
13. Indemnification
You agree to indemnify, defend, and hold harmless DAHN from any claims, damages, liabilities, or expenses arising from your use of the Service, including any violation of HIPAA or misuse of patient data.
14. Service Availability
We do not guarantee uninterrupted or error-free operation of the Service.
15. Force Majeure
DAHN shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or infrastructure failures.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Louisiana.
